Offer for Contract Conclusion

This document is published on the website https://quicksnowteach.com/ and other related domains (including https://quicksnowteach.mykajabi.com/offers/) and constitutes a public offer in accordance with the laws of Portugal and the European Union to conclude a service agreement (hereinafter referred to as the "Agreement") with any interested individual (hereinafter referred to as the "Customer").

Acceptance of this offer is deemed to occur upon the deduction of funds from the Customer's account when paying for the services of the Provider. This implies that the Customer has reviewed the online course during the 3-day trial period, is fully satisfied with the product, and agrees to use it for a period of 3 months.

1. Terms and Definitions
1.1. In this Agreement, the following terms are defined as follows:
  • Website — websites owned by the Provider, including https://quicksnowteach.com/ and other sites containing the "quicksnowteach" domain, including all subdomains of https://quicksnowteach.mykajabi.com.
  • Course — an online training program available on the Website, consisting of lessons, video tutorials, and other materials.
  • Fee — the cost of the Provider's services under the Course selected by the Customer.
  • Provider — sole proprietor Zakhodiakina Daria, tax number 313785899, registered at: R. Eurico Castro e Silva, 14, Block A, Corpo 1 - 2 ESQ, 2450-182, Nazare, Portugal.
  • Personal Account — secure pages of the Website accessible after Customer authorization.
  • Contact Email — quicksnowteach@gmail.com.

2. Subject of the Agreement
2.1. The Provider agrees to grant the Customer access to the Courses via the internet, and the Customer agrees to pay for the services in accordance with the Fees.
2.2. Information about the Course, its content, and costs is available on the Website.
2.3. Services are considered rendered upon granting the Customer access to the Course.

3. Terms of Access Provision
3.1. Access to the Course is granted after:
  • Registration of the Customer on the Website.
  • Payment for the services via Stripe, Kajabi, Apple Pay, Google Pay, or PayPal.
3.2. The Customer gains access to the Course for the period specified in the description of the respective Fee.
3.3. The Provider reserves the right to modify the content of the Courses without prior approval from the Customer.

4. Financial Terms
4.1. Service costs include VAT (23%) in accordance with Portuguese tax legislation.
4.2. Payment is made in USD through the payment systems specified on the Website and is then converted to euros within the payment systems.
4.3. Refunds are only possible in case of technical issues on the part of the Provider.
4.4. The free trial period lasts 3 days. If the Customer does not cancel the services within the trial period, the service is considered unconditionally accepted.

5. Personal Data Processing
5.1. Personal data processing is carried out via the Kajabi platform and complies with Regulation (EU) 2016/679 (GDPR).
5.2. The Provider undertakes to ensure the confidentiality of the Customer's data.

6. Liability of the Parties
6.1. The Provider is liable for fulfilling its obligations under Portuguese and EU law.
6.2. The Provider is not liable for:
  • Issues related to the Customer's internet connection.
  • Improper use of the Website functionality by the Customer.
6.3. The Customer must use access to the Course for personal purposes only and must not share their credentials with third parties.

7. Dispute Resolution Procedure
7.1. All disputes and disagreements between the parties must be resolved through a pre-trial claims procedure. The response period for a claim is 10 business days.
7.2. If the dispute cannot be resolved, it will be submitted to the courts of Portugal.

8. Intellectual Property
8.1. All Course materials, including video tutorials, textual materials, and software, are the intellectual property of the Provider.
8.2. Any transfer, copying, distribution, or use of the Course materials by third parties without the Provider's written consent is strictly prohibited and subject to prosecution under Portuguese Intellectual Property Code and EU regulations.
8.3. The Customer must promptly notify the Provider of any known violations of intellectual property rights.

9. Term and Termination of the Agreement
9.1. The Agreement comes into effect upon the Customer's acceptance of the offer.
9.2. The Customer may terminate the Agreement during the trial period (3 days) without providing reasons. To do so, the Customer must send a written notice to the Provider's email.
9.3. The Provider reserves the right to terminate the Agreement unilaterally in case of the Customer's violation of the terms of this Agreement.

10. Miscellaneous
10.1. This Agreement is governed by the laws of Portugal and the EU.
10.2. The Provider may amend the terms of the Agreement. The updated version of the Agreement will be published on the Website and will take effect upon publication.

Appendix 1: Refund Policy
  1. Refunds are only possible in case of technical issues on the Provider's part.
  2. Each case will be reviewed individually. The Provider reserves the right to approve refunds at its sole discretion without explanation.
  3. To request a refund, the Customer must send a written notice to the Provider's email within 5 business days of identifying the issue.
  4. Refunds will be processed within 14 business days of refund approval.
  5. Refunds, if applicable, will be issued by reversing the original payment transaction.
