This Safety Disclaimer and Assumption of Risk applies to all Participants taking part in camps, courses, lessons, riding sessions, travel experiences and related Services offered under the public-facing project name QuickSnowTeach.
QuickSnowTeach is a public-facing project name, brand name and website name used by the Providers to offer the Services.
Depending on the specific Service, the Provider may be self-employed professional Anton Zolotarev, self-employed professional Daria Zakhodiakina, or both, as stated on the relevant product page, booking confirmation, payment receipt, invoice or other applicable document.
By booking, paying for, attending or participating in a Service, the Participant confirms that they have read, understood and accepted this Safety Disclaimer and Assumption of Risk.
If the Client makes a booking on behalf of another Participant, the Client is responsible for ensuring that the Participant reads, understands and accepts this document before participating in the Service.
1. Nature of the ServicesThe Services may include skiing, snowboarding, riding sessions, technical feedback, video analysis, resort orientation, route suggestions, group riding, educational explanations, demonstrations, organisational support and related activities.
The exact content of each Service is stated on the relevant product page, camp page, booking page, booking confirmation or other written communication from the Provider.
The Services take place in mountain and ski resort environments, which may include changing weather, changing snow conditions, other slope users, lifts, resort rules, variable terrain and other factors outside the Provider’s control.
Unless expressly stated otherwise, the Provider is not acting as a local resort ski school, ski patrol, mountain guide, rescue service, resort operator or representative of the resort.
2. Inherent Risks of Skiing, Snowboarding and Mountain ActivitiesThe Participant acknowledges and understands that skiing, snowboarding and mountain activities involve inherent risks.
These risks may include, but are not limited to:
1. Falls;
2. Collisions with other slope users;
3. Collisions with objects, trees, fences, lift structures, signs or barriers;
4. Injuries caused by edges, boards, skis, poles or equipment;
5. Variable snow conditions;
6. Ice, hardpack, slush, powder, bumps, moguls or uneven terrain;
7. Poor visibility;
8. Changing weather conditions;
9. Wind, cold, fog, snowfall, rain or low temperatures;
10. Lift closures, delays or lift-related incidents;
11. Resort restrictions or slope closures;
12. Mistakes made by other slope users;
13. Equipment failure or incorrect equipment setup;
14. Fatigue, loss of balance or loss of control;
15. Physical strain or aggravation of existing injuries;
16. Accidents requiring medical care, mountain rescue or evacuation.
The Participant understands that these risks cannot be completely removed, even where reasonable care, instruction, guidance or organisational support is provided.
3. Participant’s ResponsibilityThe Participant is responsible for assessing their own riding level, physical condition, health, equipment and ability to participate safely.
The Participant must not take part in any exercise, route, terrain, speed, trick, riding situation or activity that they do not feel able to perform safely.
The Participant must inform the Provider or Activity Leader as soon as reasonably possible if they:
1. Feel unsafe;
2. Feel unwell;
3. Are injured;
4. Are too tired to continue safely;
5. Do not understand the task or instruction;
6. Feel that the terrain, speed, exercise or activity is above their ability;
7. Have equipment problems;
8. Need to stop or take a break.
The Participant has the right and responsibility to stop participating in any part of the Service if they do not feel safe, physically able or comfortable continuing.
4. Riding Level, Health and Medical InformationThe Participant must provide accurate and complete information about their riding level, previous experience, physical limitations, injuries, medical limitations and any other circumstances that may affect their safe participation in the Service.
The Participant should only provide health-related information that is relevant to safe participation.
If the Participant fails to provide relevant information, provides incorrect information or overstates their riding level, the Provider or Activity Leader may be unable to assess the Participant’s suitability for the selected Service.
The Provider or Activity Leader may refuse, suspend or terminate the Participant’s participation where reasonably necessary for safety reasons, including where the Participant’s level, equipment, health condition or behaviour makes participation unsafe or unsuitable.
5. Equipment and Protective GearThe Participant is responsible for using suitable and properly maintained equipment appropriate for their riding level, the selected Service, snow conditions, weather conditions and resort rules.
A helmet is mandatory for all skiing and snowboarding activities connected with the Service.
The Participant must ensure that their equipment is correctly adjusted and suitable for the activity.
Where specific protective or safety equipment is required for a particular activity, terrain or condition, the Participant must use such equipment in order to participate.
If the Participant does not have the required equipment or protective gear, the Provider or Activity Leader may refuse or suspend the Participant’s participation in the relevant part of the Service where reasonably necessary for safety reasons.
6. InsuranceThe Participant must have valid Personal Accident Insurance covering skiing or snowboarding activities.
Where applicable, the insurance must include mountain rescue and helicopter evacuation coverage.
The Participant is responsible for checking that their insurance is valid for:
1. The country where the Service takes place;
2. Skiing or snowboarding activities;
3. The type of terrain and activity involved;
4. Rescue, medical care and evacuation where required.
The Provider is not responsible for medical expenses, rescue expenses, evacuation costs or other costs that should be covered by the Participant’s insurance, unless such responsibility cannot be excluded under applicable law.
7. Resort Rules and Third-Party ServicesThe Participant must follow all applicable resort rules, lift rules, slope signs, safety instructions and general mountain safety practices.
The Participant must also follow instructions given by resort staff, lift staff, ski patrol, rescue services, police or other competent authorities.
The Provider is not responsible for the operation, safety, rules, decisions, closures, delays, pricing, services or actions of ski resorts, lift operators, equipment rental providers, transport providers, accommodation providers, restaurants, insurance providers or other third-party providers.
If the resort closes slopes, lifts, areas or facilities, or imposes restrictions, the Provider may adjust the Programme where reasonably possible.
8. Weather, Snow and Programme ChangesThe Participant understands that weather, snow conditions, visibility, lift operations, resort restrictions and group safety may affect the Programme.
The Provider or Activity Leader may adjust the Programme, schedule, riding area, route, exercises or format where reasonably necessary due to:
1. Weather conditions;
2. Snow conditions;
3. Visibility;
4. Safety reasons;
5. Resort restrictions;
6. Lift closures;
7. Group level;
8. Participant fatigue or injury;
9. Activity Leader assessment;
10. Other circumstances affecting the safe and appropriate delivery of the Service.
Such adjustments do not automatically mean that the Service has not been provided.
9. Alcohol, Drugs and Unsafe BehaviourThe Participant must not participate in skiing, snowboarding, riding sessions, mountain activities or any safety-sensitive part of the Service while under the influence of alcohol, drugs or any substance that may affect coordination, judgement, reaction time or the ability to participate safely.
The Participant must behave respectfully towards the Provider, Activity Leaders, other Participants, resort staff, local residents and other slope users.
The Participant must not behave in a way that creates a safety risk, disrupts the Programme, damages property, violates resort rules or negatively affects other Participants or third parties.
The Provider or Activity Leader may refuse, suspend or terminate the Participant’s participation if the Participant’s behaviour creates a safety risk or makes the safe and appropriate delivery of the Service unreasonable.
10. Photos and Videos for Technical FeedbackPhoto and video materials may be created during the Service for technical feedback, video analysis, safety review or internal training purposes.
Where photo or video materials are used for public marketing, social media, advertising or promotional purposes, the Provider will rely on the Participant’s consent or another appropriate legal basis where permitted by law.
The processing of personal data, including photo and video data, is described in the QuickSnowTeach Privacy Policy.
11. Personal Responsibility and Assumption of RiskThe Participant confirms that they understand the inherent risks of skiing, snowboarding and mountain activities.
The Participant voluntarily chooses to participate in the selected Service.
The Participant accepts responsibility for their own actions, decisions, riding behaviour, equipment, physical condition and compliance with safety requirements.
The Participant understands that the Provider and Activity Leaders cannot guarantee complete safety, specific snow conditions, specific weather, specific riding progress, specific technical results or an accident-free experience.
The Participant is responsible for injuries, losses, damages, fines, penalties or third-party claims caused by their own unsafe, unlawful, disrespectful or irresponsible behaviour.
12. Limitation of ResponsibilityTo the maximum extent permitted by applicable law, the Provider and Activity Leaders are not responsible for injuries, losses, damages, expenses or accidents caused by:
1. The Participant’s own actions or decisions;
2. The Participant’s failure to follow safety-related guidance or organisational instructions;
3. The Participant’s failure to follow resort rules or lift rules;
4. The Participant’s incorrect assessment of their own ability;
5. The Participant’s unsuitable or incorrectly adjusted equipment;
6. The Participant’s lack of required insurance;
7. The actions or omissions of other slope users;
8. Weather conditions, snow conditions, poor visibility or terrain conditions;
9. Resort decisions, lift closures, slope closures or third-party service disruptions;
10. Participation in activities outside the organised Programme.
Nothing in this document excludes or limits liability for any matter where such exclusion or limitation is not permitted by applicable law.
Nothing in this document limits any mandatory consumer rights that cannot be excluded or restricted under applicable law.
13. MinorsIf the Participant is under 18 years old, this document must be read and accepted by their parent or legal guardian.
The parent or legal guardian confirms that they are authorised to accept this document on behalf of the minor Participant.
The parent or legal guardian is responsible for ensuring that the minor Participant understands the safety requirements, follows resort rules and participates only within their ability.
14. ConfirmationBy booking, paying for, attending or participating in the Service, the Participant confirms that:
1. They have read and understood this Safety Disclaimer and Assumption of Risk;
2. They understand that skiing, snowboarding and mountain activities involve inherent risks;
3. They accept responsibility for participating within their own ability;
4. They will follow safety-related guidance, organisational instructions and resort rules;
5. They will wear a helmet during skiing or snowboarding activities connected with the Service;
6. They have valid Personal Accident Insurance covering skiing or snowboarding activities and, where applicable, mountain rescue and helicopter evacuation;
7. They will not participate while under the influence of alcohol, drugs or any substance that may affect safe participation;
8. They understand that the Provider may refuse, suspend or terminate participation where reasonably necessary for safety, organisational or legal reasons.
